Allgemeine Geschäftsbedingungen (AGB)

These Terms & Conditions ("Terms", "AGB") govern all purchases and workshop bookings made through the website and studio of Keramikatelier Viktoriia Kurganskaia ("we", "us", "our", "the Studio").

By placing an order, booking a workshop, or using our services, you ("Customer", "you") agree to be bound by these Terms.

2. SCOPE OF SERVICES

We offer the following services:

A. Handmade Ceramic Products

  • Functional ceramics (plates, bowls, cups, vases)

  • Decorative ceramic art pieces

  • Custom and made-to-order items (when available)

B. Workshops and Classes

  • Ceramic workshops for beginners and advanced students

  • Private group sessions

  • Specialized technique classes

Important Note About Handmade Items:
All ceramic products are handcrafted by skilled artisans. Natural variations in size, shape, color, glaze, and texture are inherent characteristics of handmade ceramics and are not considered defects or quality issues. Each piece is unique.

3. CONTRACT FORMATION

​

A. Product Orders

Product listings constitute an invitation to make an offer. By clicking "Order", you submit a binding offer to purchase. A binding contract is formed when you receive our order confirmation email.

Right to Refuse Orders:

  • Product is out of stock or discontinued

  • Pricing errors on our website

  • Payment cannot be processed or verified

  • Suspected fraudulent activity

B. Workshop Bookings

Workshop bookings require full payment in advance. A booking is confirmed only after payment is successfully processed. Workshop spots are limited and assigned on a first-come, first-served basis.

4. PRICES AND PAYMENT

Prices

  • All prices are in EUR (€) including German VAT

  • Prices displayed at time of order are binding

  • Shipping costs are additional (see Shipping Policy)

Payment Methods:
Credit/Debit Cards, PayPal, Stripe, Bank Transfer, and others as displayed at checkout.

Payment must be completed before order processing or workshop attendance. Invoices are provided electronically via email.

5. DELIVERY AND SHIPPING

All shipping and delivery matters are governed by our separate Shipping & Delivery Policy, which forms an integral part of these Terms. Shipping costs are the customer's responsibility. Delivery times are estimates, not guarantees.

6. WORKSHOP PARTICIPATION TERMS

A. Attendance and Punctuality

  • Arrive 10 minutes before scheduled start time

  • Late arrival does not extend class duration or entitle refund

  • More than 30 minutes late may result in denied entry without refund

B. Age Requirements

  • Minimum age: 12 years (unless otherwise specified)

  • Children under 12 only for child-friendly workshops

  • Children must be accompanied by participating adult

C. Health and Safety

  • Inform us of allergies, health conditions, or mobility limitations before workshop

  • Follow all safety instructions provided by instructor

D. Clothing and Personal Items

  • Wear comfortable, expendable clothing; clay stains are difficult to remove

  • Closed-toe shoes required; long hair tied back

  • We are not responsible for damage to personal clothing or items

E. Behavior and Conduct

  • Treat instructors, staff, and participants with respect

  • Disruptive or dangerous behavior may result in removal without refund

  • No alcohol or illegal substances permitted

F. Finished Work

  • Ceramic pieces require drying and firing (3-6 weeks)

  • You will be notified when pieces are ready for pickup

  • Pickup must be arranged within 60 days

  • We are not responsible for cracks or imperfections during firing (natural part of ceramics)

7. RIGHT OF WITHDRAWAL (WIDERRUFSRECHT)

For EU Customers

In accordance with German Civil Code (BGB § 312g) and EU Consumer Rights Directive, you have the right to cancel your order within 14 days without giving reasons.

How to Exercise Your Right:

Send a clear written statement to: [insert email] or our postal address

Exceptions to Right of Withdrawal (§ 312g Abs. 2 BGB):

  • Custom-made or personalized items (§ 312g Abs. 2 Nr. 1 BGB)

  • Sealed goods unsealed after delivery (hygiene reasons)

  • Workshop services fully performed with your explicit consent

Refunds:

If withdrawal is valid, we will refund all payments within 14 days after receiving your withdrawal notice. You bear the direct costs of returning goods.

8. WARRANTY AND DEFECTS (GEWÄHRLEISTUNG)

You have statutory warranty rights under German law (BGB §§ 433, 434, 437). Goods must be free from defects at delivery. Warranty period: 2 years from delivery.

Natural Characteristics NOT Defects:

  • Slight variations in size, shape, color, or glaze

  • Small irregularities, bubbles, or texture variations

  • Differences from product photos

  • Hairline crazing in glaze (natural characteristic)

Reporting Defects:

Inspect goods upon receipt and notify us within 7 days for visible defects with photos and order number.

Remedies:

For confirmed defects: Repair or Replacement. If impossible or fails twice: Price reduction or Refund.

9. LIABILITY AND LIMITATION (HAFTUNG)

A. Unlimited Liability
We are fully liable for damages caused by intentional misconduct, gross negligence, injury to life/body/health, breach of guaranteed characteristics, or claims under Product Liability Act.

B. Limited Liability
For slight negligence, we are liable only if we breach an essential contractual obligation. Liability is limited to foreseeable, typical damages.

C. Exclusions

  • Misuse of products

  • Damage after delivery

  • Personal belongings damaged during workshops

  • Delays caused by carriers or customs

  • Natural breakage or wear and tear

10. DATA PROTECTION (DATENSCHUTZ)

We process your personal data in accordance with EU GDPR and German BDSG. For details, please review our Privacy Policy, available on our website. We collect only necessary data, do not sell to third parties, and you have rights to access, correction, deletion, and data portability.

11. INTELLECTUAL PROPERTY

All content (designs, photos, workshop materials, text, graphics, logos) is the exclusive intellectual property of Viktoriia Kravchenko and Keramikatelier Viktoriia Kurganskaia, protected by copyright law.

Permitted Use:

  • Personal, non-commercial viewing

  • Share photos of purchased ceramics on social media

  • Use workshop techniques for personal projects

Prohibited Without Permission:

  • Commercial reproduction or redistribution

  • Mass-production of our designs

  • Using techniques to teach commercial workshops

12. FORCE MAJEURE

Force Majeure includes events beyond our reasonable control (natural disasters, pandemic, war, strikes, studio emergencies). If Force Majeure prevents fulfilling obligations: for product orders, we offer refund or alternative; for workshops, we reschedule or offer full refund.

13. WORKSHOP CANCELLATIONS

Please refer to our Refund & Cancellation Policy for full details. Summary: More than 24 days before: Full refund; 21-24 days before: 50% refund; Less than 21 days: No refund (transfer option may be available).

14. ONLINE DISPUTE RESOLUTION

15. FINAL PROVISIONS

A. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding CISG. Mandatory consumer protection laws of your country remain applicable.

B. Place of Jurisdiction
For disputes with merchants: Hamburg, Germany. For consumers: determined by statutory law.

C. Severability
If any provision is invalid, remaining provisions remain in effect.

D. Changes to Terms
We reserve the right to update these Terms. Material changes will be communicated. The version in effect at time of your order/booking applies.

E. Entire Agreement
These Terms, together with Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement.

16. SPECIAL PROVISIONS FOR BUSINESS CUSTOMERS

If purchasing as a business (Unternehmer): Right of withdrawal does not apply; warranty period may be reduced to 1 year; place of delivery equals place of performance; you bear burden of proof for defects.
